This blog is dedicated to all the Trayvon Martins and Vets with PTSD and the minorities and poor who are getting their civil rights taken or abused, police brutality, judicial misconduct, racial injustice and corrupt city, state Public officials, unconstitutional ordinances and unconstitutional rogue cops that enforse them. This started because when I moved to this backward rascist, unjust, unconstitutional police city Swainsboro Georgia, it was so bad in the laws they pass and the way they treat Vet’s as me with PTSD and minorities and judicial and public official abuse and misconduct, it was so bad I had to start this page, Because as is with most all groups of Citizens listed above, I was not rich enough to sue to get justice and now must live as a prisoner in my own house, as a result of the unconstitutional city ordinances, public officials, jail and rogue cops that abuse and misuse their power here and they did this to me a 61 year old female Vet, with severe PTSD and two deadly diseases, both which can cause me to go medically psychotic and die when stressed, and cops here acting on unconstitutional laws, almost killed me on July 3rd and 6th of 2013, just because I raised my voice and cussed at a officer, who provoked me into a PTSD and psychotic state. Then on 6th again they where going to arrest me for disorderly conduct for exercising my freedoms I fought for, that cop was so agressive he sent me into a total mental, emotional and physical meltdown, if I had not ran to my part of house and called VA hotline, they would have taken me to thier jail, where I would have died because of this rare disease, as I am homebound, because this disease makes it where I cannot breathe, wear, eat or drink anything with chemicals, pesticides, perservatives or additives, so if I had not had the foresight to call Va hotline, the rogue cops here, would have taken me to jail that is filthy and it would have killed me, all because I exercised my freedoms of speech and expression, they did this the same night to a Black Vet for the second time, last year they arrested and tazed him for same thing, I tried to talk to Chief of Police Randy Allison and to Mayor Schwabe of Swainsboro Police department, but they used the excuse that their officers where acting under unconstitutional ordinances and therefore where only doing their job. Then I wrote to Mayor Schwabe, he did nothing, but defend his officers, So in order to maybe find a way to change this town, keep them from provoking any Vet here into a PTSD state and then arresting them and taking their civil liberties they fought for, and to keep them from rascial injustice towards minorities, mentally ill and poor, until I find a way to make them change and take them to task for what they did to me and so many others here, I decided to use the maybe only freedom we have left, the internet, so that all who are being treated like this, and all Vet’s who have PTSD and are being provoked into a PTSD state by unconstitutional ordinances or laws and rogue cops who enforse them, and for the mentally ill  and poor being racked up for the least of things, with no recourse because of a lack of money, and racial discrimination at least here, we can call these Unconstitutional Police Cities and Rogue abusing cops and freedom rights taking public officials to task, by Naming and Shaming them on internet, so that when someone else decides to come to these kind of backwards, unconstitutional, rascist, unjust, rogue cop cities, they may be able to read about them first, when we all come to my page here and Name and Shame the towns, the public officials, the unconstitutional laws and rogue cops, maybe then, they will feel our pain and see the shame and realize that no one, not them or their money or connections or postitons of power, allow them to operate above the Constitution of America, that all Soldiers fight for, for in truth,  Swiansboro Georgia and Kite Georgia by the unconstitutional and unjust way, they treat Vets, who pay the ultimate price in death or physical loss or mentally damaged, this town and all like it, mock the blood of every Soldier that has ever fought and died for this United States Constitution, that their own ancestors put into place,,,,,,,,,,,,,,,,,My wish for this page is that many many will report abuse of power, rogue cops, filthy agressive ran jails and unconstitutional laws, so that maybe if enough of us do this, we can Name and Shame them and Stop them, thank you Betty Sullivan RoundHead

This unconstitutional Vet Hating, cop abusing backward small southern city, Swainsboro Georgia and all of Emanuel County, just like the City,  and espiecially ate up rascist Kite Georgia, also in this county, when I thought they couldn’t get worse, when they threatened to take me, a 61 year old female Vietnam PTSD Vet to jail, just because, when they where arresting my care givers, I have to have because of the two rare deadly diseases I have, when I spoke up in loud voice, and said a cuss words, cops threatened to arrrest me, to hell with the fact that I am a soldier that fought for the right to my constitutional freedoms, they don’t care here,  so they where going to arrest me for disorderly conduct, which because of my two rare diseases would kill me if I went to jail, but luckly I had VA hotline on phone, recording cops, so they didn’t arrest me, now I am putting my speech on signs in front yard, and practicing my freedom of Speech that way, then I find out, they made a law, that makes it illegal to do any thing their Christian faith says is bad, no astrology, no numerology, esp, palmstry, clairvoyance, so by doing that they Discriminated against me as a American Indian, for we have done all those things for thousands of years, so they protect their religion and it’s practices and take other religions practices away. They also where the same ones, that screamed the loudest, when they thought President Obama was going to take thier Constitutional Right to bare arms away, they ranted and raved and called President Obama the n word and more and the threats they made, as to what they would do, if their dam rights where took away, where as bad as things they did in not so Civil War, but that shows their neverending hypocracy here, and the rascism is bad here, and the judicial system is like cattle being herded , one public defender, for whole Emanuel County, and she tells most everyone to cop to the charges, so this is the new way to take voting rights and food stamps from blacks, minorities and poor, for they know they can’t hire a lawer so they will offer them to cop for a low grade felony, knowing this takes their voting rights away and if it is drugs, their foodstamps also, so welcome to the new Georgia Modern Plantation Owners and Rulers, Same Masters, Same Attitude, just new era. Dear President Obama, I am a 61 year old female Vet, I moved to this small rascist backwater southern town 4 years ago, in July officers acting under a totally unconstitutional ordinance, as taken the right of speech and is discriminating against me as a Native American, by making a ordinance that does not allow anything that goes against their christain religion to be praticed, but is practiced by us Native Americans, stuff like no astrology, no ESP, no fortune telling, clarivoyance etc, so this not only goes against my freedom of religion and equal protection, but disciminates against me as a Native American because we do all the things outlawed, also they have in ordinance, so cussing or obscene gestures at all to anyone, & because of that in July cops came at me, when arresting my care givers, in a agressive tone & manner as they do many Vets here, then arrest the Vet when they send them into a PTSD state,when they cuss or yell while in that state, & I have 2 rare deadly diseases that will kill me, before they could process me into jail,I moved here 4 years ago and
 the rascism and police & judical way of doing justice, is done in such a way, that most all have tto cop to felony's, to get probation, but at same time, this town knows bt doing this, they aare taking their rights to vote & for foodstamps if drug felony, it is the blacks, poor & minorities like me that suffer for this the most, as they only have one public defender 4 this whole county, so they herd them llike cattle in court, please help us Vet's & minorities here, & don't let them take my Native America Spiritual practices from me Please, Thank u

Well even though my Son and his girlfriend are in jail and so my caregivers are gone, and it has been a over a 32 hours, no bond, no first appearance, and cops threatening to take me to jail, even though I told them it would kill me because of my very rare allergy leukemic disease, which makes me unable to leave house or be around anything not natural, just because I cussed their assess out and flipped them the bird, then dared them to take me to jail, they were going to for disorderly conduct, until I enlightened them that the Supreme Court had a case in which a couple yelled and cussed and gave finger to cops and was charged with disorderly conduct and the Supreme court ruled for the couple that yelling and cussing the cops was protected under freedom of speech and that giving them the finger was protected under freedom of expression, so once I quoted this supreme court ruling to them I dared them to take me to jail, for that and because they stressed me after I warned them if I get stressed this rare disease causes me to release millions of mast cells and toxic histimines into my brain and sends me into a state of medical psychosis and causes me to get paranoid, and hostile and dilusional, so I told them that tommorow I will call ACLU and sue them for not only causes me to become sick but for causing me to become medically psychotic and then going off on them and them trying to take my constitutional rights away, by turning those rights into disorderly conduct,
NOW THEY TOOK MY SON AND HIS GIRLFRIEND TO JAIL MY ONLY CAREGIVERS THEY SAY FOR STEALING A PLANT, BUT YET WHEN I CALLED THEM FOUR TIMES ON MAN ACROSS THE STREET FOR NEGLECTING AND ABUSING HIS DOG, THEY DID NOTHING, SO THEY CARE MORE ABOUT A MATERIAL PLANT, THAT MY SON OR GIRLFRIEND DID NOT HAVE ON THEM, JUST SOMEONE SAYING THEY DID IT, WHILE NOT GIVING A DAM THAT A DOG IS BEING ABUSED AND NEGLECTED HERE IN MY HELL, CALLED SWAINSBORO GEORGIA

I thank you for your offer, but as far as the police, I talked to the Chief and he said, that no officers where dispatched out here on July 6th, but that is not so, a officer name Corey came and unlawfully went into my son's apartment, and I was already in a total state of PTSD and medical psychosis brought on by my rare miloproleferated systemic mastocytosis, when officers that arrested my son and his girlfriend just because someone said they saw them with a stolen plant, my sons girlfriend was walking my dog, they where not caught at a scene of stealing anything nor caught with any stolen property only one old ladys word and they are  my full time care givers that I must have, and when I questioned his reason for arresting my son, and raised my voice,the officer threatened to take me to jail for disorderly conduct,  and with my rare disease if I go to jail it will kill me, as I am home bound and cannot be outside or around any unatural things, so his agressiveness sent me into a total PTSD state and medically psychotic state and my alter split personality came out and cussed and flipped him the bird and he was going to arrest me, and I told him the Supreme court said cussing a cop, calling him names, questioning them, arqueing with them and giving them a obcene gesture as been ruled by Supreme court as freedom of speech and freedom of expression, I then went into mast cell melt down and allergy shock over that July 3rd insident, then on July 6th a cop came to my door, and said he came to get medicine for my sons girlfriend they arrested on the 3rd, I told him, they lived in the apartment attached to my house, I asked him to wait outside as I was still in a state of terror and medical psychosis, but he came into apartment anyway and that set off my PTSD again and a total medical psychoitc melt down and so I cussed and told him, and I left apartment and I cussed him and when I did he got right in my face, his name is Corey something and he threatened me to arrest me for disorderly conduct and then I knew that would kill me so my mast cells got so bad, I was in meltdown and going into allergic shock, so I called VA emergency hotline and I was talking to them for about 30 minutes when 3 more officers came and that flipped me so bad, I handed phone with VA hotline lady on it and had her talk to the cops, then paramedics came and I was going into allergic shock and then I just got report and they accused me of being aggressive to those officers when I never left my house and did nothing to them, and my x daughter in law that lives with me, that just finished 3 years of law school was a witness I did nothing aggressive to officers and so does VA Hotline lady who is preparing a recording of the whole incident for me, and she suggested I call the ACLU and bring a law suit for officers putting me into a stare of PTSD and medical psychosis and allergic shock, as she agreed the Supreme court did say cussing, arqueing etc is protected in constitution and that no Vet with PTSD should be treated in such a manner, expiecially a 61 year  old woman vet with severe PTSD and two rare deadly diseases, so this cannot happen in the future to Vets exerrcising the rights they fought for, I told the cop that came into apartment when he illegally entered it and caused me to cuss him and he threatened to arrest me, that supreme court said not only can anyoine do that, but no crime can be charged as a result of anyone practicing those constitutional rights, that cop said he did not give a dam what the supreme court said, and I guess he was one that called three more cops, so I did as u said and Monday I tried to talk to Chief to make a complaint against the officer that put me on psychotic state on July 3rd and July 6th and what happened and he even said, If I talk dirty they can arrest me, and that he didn't dispatch any officers to my house on Saturday and has no report of it, but yet paramedics say  I was aggressive towards cops that chief said was not sent here, and VA Hotline lady talkk to cops he said was not here and my x daughter in law was here when cops he said wasn't sent her, so how can I talk to a Chief that after letting him know what I did was my constitutional right and him say I can't do it and say he sent no cops here, when I have multiple witnesses they where and everyone lying for the cops,,,,,,,,,,so my mast cell specialist and my VA shrink and ACLU, told me to get officers name which poIice chief has not given and who is saying no cops came here saturday, the VA is very concerned about me and said the way this town is treating any Vet is wrong, but espiecially Vets with severe PTSD and me two rare deadly diseases that can kill me instantyl if I am stressed or around any unnatural thing, this started in end of June when I called about dog across the street at 302 W Church St Apt A being abused and neglected and cops did nothiing so I sent pics of dog through FB, YouTube, SPCA and PETA, PETA emailed me back and said they are going to handle the dog, as the pictures show the dog has severe dermatitis from flea infestation, I tried to get help from Chief on dog when officers did nothing for dog, by emailing  pictures of dog to the Chief, he did nothing so I was forced to go to PETA,SPCA and to the White house, that is why they don't like me, and because even though I am not a Hacker, I belong to Anonymous and to a Native American Womens Veterans group with access to the White House and President Obama and to head of VA, so when cops did these other things to me.on July 3rd and 6th, it is because the cops have made it clear, they do not care about VETS, and they will not allow anyone to question them, arque with them, use bad language or give obscene gestrues and will arrest such persons even after I told them it was unconstitutional to threaten me or anyone, so they terrorized a 61 VET and caused me to go psychotic and almost died for exercising my constituional rights, I fought for then lie and cover for cops while neglecting dog abusing is left alone to continue to abuse and neglect that dog, that started this whole thing,,,,,,,,,so tell me how I can trust this Police Chief or Department, 3 of the officers on July 3rd that arrested my son and his girlfriend my caregivers where nice, one that threatened me into terror not good, cop that came on July 6th and illegally entered my sons apartment and threatened me into a total psychotic melt down and allergic shock very bad cop, the 3other cops that showed up after he came that talked to VA lady I was in such a psychotic meltdown I can't say anything about those cops as I was totally in shock,,,,,,,,,,,,,so I cannot work this out in the way you are suggesting as long as these cops lie for each other and continue to say, they will not respect the constitutional rights to cuss, arque,question and use obscene gestures, nothing can be done until they understand that this is my and everyones right and that supreme court said they cannot treaten action and now I know and feel they are out to get me anyway they can and my son and his girlfirend also......all because we stood up I regret that you have had a stressful experience involving City law enforcement.  I am certainly willing to offer whatever assistance I may in any discussion or resolution of any situation that you feel was mishandled by City personnel. 

 

 I am very proud of our Police Department and have great trust in the judgment of Chief Ellision. Many of our officers are also veterans and I would be very surprised if you did not receive fair treatment from them.  I would suggest that you request some time from the Chief to carefully address your concerns, and if I need to become involved, I will do so, as I did in the situation with the drainage issue under you house.  

 

I hope that you are feeling better now, and that we can work with you to ensure that this does not happen again in the future.

I would like you to get these unconstitutional city ordinances changed, so that I can has a Native American practice my ancient traditional ceromonies and to be able to do my paranormal research and if possible to get rid of the ordinances they are using to give cops right to come at Vet's with PTSD in aggressive manner and tone, provoking them into a PTSD state, then arresting them for disorderly conduct, for doing nothing more than acting in a PTSD State they go serving this country and for exercising the consttutional rights they fought for, and for all the other minorities and poor that they are using these unconstitutional ordinances to rack them up, to keep getting fines, probation money over and over,

That is followed by a presentation of some cases in which courts have upheld arrests that were arguably speech-related because the arrestee.s conduct crossed the line from pure advocacy of ideas to fighting words, active obstruction of officers, or incitement to imminent unlawful actions, including violence.

An important decision establishing a dividing line concerning what words alone can be criminalized is Brandenburg v. Ohio, #492, 395 U.S. 444 (1969), setting forth the legal standard that even advocacy of unlawful acts may not be criminally punished unless they amount to ¡§incitement to imminent lawless action.¡¨ This was distinguished from ¡§mere advocacy¡¨ of unlawful conduct, including violence.

 

In Lewis v. City of New Orleans, #70-5323, 415 U.S. 130 (1974), a woman yelled obscenities and threats at an officer who had asked her husband to show his driver.s license. She was convicted of violating an ordinance making it a crime ¡°for any person wantonly to curse or revile or to use obscene or opprobrious language toward or with reference to any member of the city police while in the actual performance of his duty.¡± The U.S. Supreme Court held that such an ordinance was overbroad and vacated the conviction, commenting that ¡°a properly trained officer may reasonably be expected to exercise a higher degree of restraint¡± than an average private person, and therefore be less likely ¡°to respond belligerently¡± to fighting words.
The leading modern U.S. Supreme Court case on the right of members of the public to express criticism of the police is Houston v. Hill, #86-243, 482 U.S. 451 (1987). In this case, a man shouted at police officers to try to divert their attention from his friend during a confrontation. He was then arrested for willfully interrupting an officer by verbal challenge during an investigation. The arresting officers claimed that this violated an ordinance making it unlawful to ¡°to assault, strike or in any manner oppose, molest, abuse or interrupt any policeman in the execution of his duty.¡± The arrestee was acquitted of the charges, and sued, claiming that the ordinance was unconstitutional and violative of his First Amendment rights. The U.S. Supreme Court held that it was unconstitutionally overbroad and therefore invalid on its face. Taken literally, it criminalized a substantial amount of constitutionally protected speech, the Court stated. It further provided officers with unbridled discretion as to who to arrest for purported violations.

 

“The freedom of individuals verbally to oppose or challenge police action without thereby risking arrest is one of the principal characteristics by which we distinguish a free nation from a police state,” the Court concluded. In a myriad of cases, the lower courts have applied these principles, allowing members of the public broad freedom of expression to criticize police, even very harshly, while drawing the line at speech, or speech joined with conduct, that involves the utterance of fighting words, active obstruction of officers performing their duties, or incitement to imminent acts of violence or other unlawful acts.

 

Broad freedom of expression Criticism of police officers, cursing at them, and even making disrespectful or profane gestures towards them, such as ¡°giving them the finger¡± have been held to be protected First Amendment speech by many courts.
In Kennedy v. City of Villa Hills, #09-6442, 2011 U.S. App. Lexis 5985 (6th Cir.), the court ruled that an officer who arrested a man for disorderly conduct after he called the officer an ¡°SOB¡± and a ¡°flat slob¡± was not entitled to qualified immunity from a federal civil rights claim. The arrestee.s voice may not have been loud enough to be unreasonable, and the officer.s decision to arrest him may have been motivated by retaliation against the arrestee for exercising his First Amendment rights.
Similarly, in Duran v. City of Douglas, Arizona, #89-15236, 904 F.2d 1372 (9th Cir. 1990), a federal appeals court held that profanities and obscene gestures directed at ao

police officer by a car passenger were speech and conduct protected by the First Amendment.

See also Nichols v. Chacon, #99-5180, 110 F. Supp. 2d 1099 (W.D. Ark. 2000), in which a federal trial court ruled that a motorist.s gesture of displaying his middle finger to an officer driving by was protected First Amendment speech. The officer was not entitled to qualified immunity and could be held liable for arresting the motorist for disorderly conduct.
General criticism of police, even if expressed in abusive terms, is generally protected free speech. In Resek v. City of Huntington Beach, #01-56029, 41 Fed. Appx. 57 (9th Cir. 2002), the court found that a police officer did not act reasonably in arresting a man for shouting abusive comments at officers and answering them with sarcasm, which ¡°amounted to no more than criticism of the police¡± and did not constitute either fighting words or incitement of others to imminent unlawful violence.
See also, Johnson v. Campbell, #02-3580, 332 F.3d 199 (3rd Cir. 2003), in which a federal appeals court granted judgment as a matter of law to an African-American high school basketball coach arrested by a police officer solely for calling him a ¡°son of a bitch.¡± The arrestee.s statement did not constitute ¡°fighting words,¡± and were therefore protected by the First Amendment.
In Greene v. Barber, #01-1247, 310 F.3d 889 (6th Cir. 2002), the court held that an arrestee, in characterizing an officer as an ¡°asshole,¡± did not say anything sufficient to place the statement outside the protection of the First Amendment as ¡°fighting words.¡± Additionally, even if the officer had probable cause to make an arrest for violation of the city.s civil disturbance ordinance, there would be no justification for the arrest if the officer actually was motivated by retaliation for the arrestee.s statements prior to the arrest.
In Gulliford v. Pierce County, #96-35614, 136 F.3d 1345 (9th Cir. 1998), cert. denied, 1998 U.S. Lexis 4989, the court ruled that verbal protests or challenges to the police are permitted, even if they knowingly hinder, delay or obstruct the police. The appeals court ruled that, to be criminal, the words must be fighting words.

Incitement of imminent lawless action was required in Spier v. Elaesser, #C-l-01-054, 267 F. Supp. 2d 806 (S.D. Ohio 2003), before First Amendment protection could be lost for harsh criticism of the police. The court found that an arrestee.s chanting of words in protest of the police requirement that persons seeking to attend a protest rally submit to a pat down search, including ¡°two, four, six, eight, fuck the police state,¡± was constitutionally protected speech under the First Amendment for which he could not face arrest for disorderly conduct in the absence of any evidence that his words presented a ¡°clear and present danger¡± of a violent reaction by the crowd. The arresting officer, however, was entitled to qualified immunity from liability, since he believed that the arrestee was trying to incite the crowd, which had become disorderly the previous day.
Mere distraction is insufficient for speech to constitute interference with or obstructing an officer. In DeRosa v. Sheriff of Collier County, Florida, #10-14046, 2011 U.S. App. Lexis 4057 (Unplub. 11th Cir.), after a deputy stopped her husband.s car, in which she was a passenger, and ticketed him for failing to dim its high beam lights, a woman called 911 to express her fears of the deputy, who she described as ¡°shaking, agitated, and nervous,¡± and requested that other officers meet the couple at a local gas station, because the deputy had activated his lights and siren and was following them. She had criticized him during the stop and been told to ¡°shut up.¡± At the gas station, the deputy instructed another officer to arrest the woman for obstructing an officer without violence. The other officer did so, grabbing her arm as she climbed out of the vehicle, dragging her to his patrol car, pushing her against the hood to handcuff her, and then shoving her inside. A federal appeals court found that the deputy did not have probable cause to order the woman.s arrest under these circumstances. Her criticisms of the deputy during and after the traffic stop, even if distracting, did not incite others against, interfere with, or impede the deputy from citing her husband for his traffic infraction.ýïýïý

 

Similarly, in Copeland v. Locke, #09-2485, 613 F.3d 875 (8th Cir. 2010), a police chief was not entitled to summary judgment in a false arrest lawsuit filed by a man taken into custody for allegedly interfering with official police conduct. The record in the case showed that the arrestee cursed at and “distracted” the police chief, whose car was blocking access to his business. This conduct did indicate that the arrestee intended to

Similarly, in Copeland v. Arrests based solely or largely on the content of speech critical of officers can lead to federal civil rights liability. In Lowe v. Spears, #07-1497, 2007 U.S. App. Lexis 29488 (Unpub. 4th Cir.), a police officer who allegedly arrested the plaintiff for criticizing him for writing tickets, rather than for illegal parking, was not entitled to qualified immunity in a lawsuit over alleged violation of First Amendment rights. The officer was writing parking tickets, and wrote one for the plaintiff, who tried to explain he was only parking on the sidewalk temporarily in front of his apartment building to unload, and that he was handicapped, with a handicap parking permit. When the plaintiff stepped into the building and warned his employees working at the apartment building that they should move their vehicles because the officer was writing tickets, the officer allegedly stated that he was ¡°tired¡± of the plaintiff.s ¡°mouth,¡± so that the plaintiff was going to jail, grabbing him by the arm and attempting to pull him out of the building. Other officers arrived on the scene and told the officer to leave the plaintiff alone. Making an arrest that was based entirely on an arrestee.s speech opposing or questioning police actions violated the First Amendment.

 

 

Conclusion Making inappropriate arrests of individuals for “contempt of cop” in circumstances where courts will find their actions to be merely the exercise of their First Amendment rights of free speech can be counter-productive, both in terms of community relations and potential civil liability. On the other hand, the right of free speech, which is part of the law and guaranteed freedoms that law enforcement officers are sworn to protect,
